Buyers Beware

Tennessee has mandated that brokers for buyers and sellers express their relationship in writing. To view a commonly used agency disclosure click here. This is done for one reason, to protect the consumer. Look at the following scenario.

Billy & Belinda Buyer see a house they like at 123 Main St in Jackson, TN. Billy calls the number on the real estate sign,it is Amanda the Agent. After some brief conversation about the house Amanda tells the Buyers that she is acting as an agent for the seller. From this point everything Billy and Belinda tell Amanda can be passed on to the seller. What?? How can that be? In this situation, she represents the seller. How much negotiating power could Billy and Belinda have lost in this example?

Will I put your home in the newspaper?

Self-proclaimed real estate gurus have been preaching against print ads for 10 years or more. They claim that the internet has arrived and print is dead. Living and practicing in a small town I strongly disagreed with them. People around these parts sit in the coffee shop every morning scouring the paper for conversation. My second year as an agent, I started running a weekly ad of my listings. It wasn’t long until my ad had grown to 2 full pages. I often ran into people who would say things like, “You sure are selling a bunch” or “I told my cousin to call you, you’ve got everything for sale”. Everything the gurus said appeared to be incorrect in a rural setting. Then the inevitable set in, somewhere along the road I noticed my “paper calls” slowing and my email leads increasing. One week I decided to call my editor and make a large change to my ad. I removed the address and price form every listing in order to gauge the effectiveness of the ad. The results…..(Drum Roll Please)……….I received no “paper calls” over an extended period of time.
